The rules, by area

What each area covers, the texts that set it, and what the official pages say.

Technical requirements and age grading

What Portaria 302/2021 sets for toys, and how age grades work.

  • Portaria 302/2021 sets the technical requirements for toys and makes certification compulsory and registration mandatory for sale in Brazil (INMETRO FAQ).
  • Age grading follows ABNT ISO 8124-8: toys for 0 to 3 years may not have small parts that can be swallowed, toys up to 5 years may not contain glass, and chemistry sets are not recommended under 8.
  • An electric toy has at least one function that depends on electricity, up to 24 volts; products above 24 V, and vehicles for use on public roads, are not electric toys.
  • Brazil has regulated toy safety since 1992 (Portaria Inmetro/MJ 47 of 13 March 1992), with compulsory certification.

How we help: Compliant Always reads your test reports against the requirements for the toy's age grade, and keeps them with the product. Ask about this

Certification and registration

Compulsory certification by an accredited body, then registration with INMETRO.

  • Certification is carried out by a product certification body accredited by INMETRO, under the general requirements in Portaria 200/2021 (RGCP).
  • The certificate of conformity is a condition for registering the toy with INMETRO (INMETRO FAQ).
  • Where registration applies, the seal and sale depend on the object's registration (Registro de Objeto) (Portaria 200/2021).
  • The transition ended on 1 July 2025: after that date, toys on sale must carry the registration number on the seal.

How we help: Compliant Always keeps the certificate and the INMETRO registration with each toy, dated, and shows when a certificate is due to expire. Ask about this

The conformity seal

Where the seal goes and what it shows.

  • The Conformity Identification Seal (Selo de Identificação da Conformidade) is printed on the label or pack, visibly, clearly and indelibly, following the models in Annex III of Portaria 302/2021.
  • Toys sold loose or without individual packaging carry the seal on the toy or attached to it, with the registration number.
  • A product that contains a toy as a gift that is not visible carries the phrase "ATENÇÃO: Contém brinquedo certificado no âmbito do Sistema Brasileiro de Avaliação da Conformidade" (contains a toy certified under the Brazilian conformity assessment system).
  • Imported products carry the seal before they enter Brazil (Portaria 200/2021).
  • In online sales, the seal information must be visible on each page offering the product (Portaria 178/2022).

How we help: Compliant Always reads your pack artwork and online listings for the seal and registration number, and shows where they are missing. Ask about this

Import consent

INMETRO's role at the border.

  • INMETRO consents to import licences (LPCO and LI) for products subject to compulsory regulation, under Portaria 137/2022, through the Orquestra system (INMETRO import consent page).
  • In INMETRO's 2020 risk classification, toys are risk III, the class that keeps registration and import consent (Portaria 282/2020).

How we help: Compliant Always keeps the certificate and registration with each shipment so the import consent has its documents on file. Ask about this

Market checks and penalties

How toys are checked once on sale, and what follows a breach.

  • Market checks are carried out by the Brazilian Network of Legal Metrology and Quality (RBMLQ-I): formal checks of the seal, the registration and the mandatory markings, and technical checks by testing.
  • Breaches can lead to the penalties in Law 9.933/1999: warning, fine, ban, seizure, destruction, and suspension or cancellation of the registration (Article 8).
  • Fines range from R$100 to R$1,500,000 (Article 9).
  • INMETRO records consumer accidents involving products through its consumer accident system (SINMAC).
  • Under the Consumer Defence Code, a supplier that learns of a danger after sale must inform the authorities and consumers immediately (Article 10).

How we help: Compliant Always keeps the certificates, registration and test reports for each toy together, so a market check or retailer question is answered from the record. Ask about this
